Charter of demand

Part I. 6^th CPC related issues

1. Grant Rs 10000 as minimum wage as per 15 ILC Norms.

2. Grant minimum fitment benefit of 2.625 times of pre-revised basic pay to bring about uniform rise of 40% in emoluments and raise grade pay to 50% of the maximum of the pre-revised scales in respect of PB 1,2 & 3 as has been done in the case of PB 4.

3. No abolition of Gr.D. Posts and functions. Lift ban on recruitment, fill up all vacant posts and scrap screening Committee.

4. Grant 10% of pay+ Grade pay as minimum benefit on promotion or financial up gradation.

5. Fix the date of effect of all allowances as 1.1.2006.

6. No performance related pay or bonus scheme

7. Revise the Transport and daily allowances as demanded by the staff side JCM National Council.

8. Remove the condition of 6 months for applying the uniform date of Ist July as increment dates.

9 . ACP to be on hierarchical system obtaining in each department.

10. Retain and improve CGHS and make insurance scheme optional

.

11. Implement flexitime working hours for women/disabled employees as recommended by the 6 CPC and remove clause (iv) of OM No.13019/2/2008-Estt.(L) dated 18th Nov. 2008 on Child Care Leave.

12. Direct all the Departmental Heads to settle 6^th CPC related department specific demands/problems within a stipulated time

13. Grant civil servant status and Pension to 'Gramin Dak-Sevaks.'

14. No reduction in the commutation value and restoration of full pension after 12 years.

15. Compute the pension entitlement on the basis of notional pay as on 1.1.1996

Part II

Demands pending settlement for long in the National Council JCM

1. No outsourcing or contractorisation of Govt. functions.

2. Grant statutory defined pension scheme to the employees recruited after 1.1.2004 and withdraw the PFRDA Bill from Parliament.

3. Implement the Board of Arbitration Awards.

4.Remove the arbitrary 5% ceiling and 3 years condition on compassionate appointment and withdraw court cases and absorb all waitlisted RRR candidates.

5. Implement the revision of bonus ceiling @ 3500/- in the case of all personnel employed by the Government including casual/contingent and daily rated workers and Grameen Dak Sewaks. Replace adhoc bonus with the PLB and remove the 60 days ceiling.

Dear Comrades,

 

The global economic recession in developed countries and its reflection in Indian economy due to the neo liberal economic policies pursued by the successive Govts in India during the last one and half decade forced the Govt. to stimulate selected sectors of industry.. However it seems to have not learnt its lesion.   In spite of the bankruptcy and closure of the so-called world  financial institutions and Insurance  giants, the Govt. of India is bent upon  in its pursuit of further liberalizing the economy and privatizing the assiduously built public sector organizations like LIC.. The Govt. is introducing the bill to amend LIC Act (to increase equity from 5Crores to !00 Cr.) in Lok Sabha on Monday  22.12.2008.  Another Bill  to raise money from Market (disinvestment) is to be introduced in Raja Sabha on the same day to allow public Sector Insurance Companies to raise money from market.  Unions in LIC and General Insurance Companies are preparing for a one day protest Strike on the next day i.e. 23^rd December, 2008. The State COCs and all affiliated organizations are therefore requested to organize solidarity  protest a demonstration on that day.  The COCs may chalk out and organize programmes on 23.12.2008 alongwith the Unions in the Banking sector, as we have been informed that BEFI has also conveyed similar decision to all its units..

Dear Comrade.

This is in continuation of our Circular No. D-20/ dated 13.12.08. As discussed in National Executive, the modified Charter of Demand is enclosed.

The National Executive has decided to organize campaign conventions in all state capitals preferably between 6^th and 9^th Jan.2009. The tour programme of the members of the Sect. of the Confederation is enclosed. The COC may kindly take steps to convene the convention on the prescribed dates without fail. It will be difficult to change the date as such change will bring about a cascading effect and will make the programme impracticable. Therefore, the COCs may adhere to the date. The Convention for Gujarat has to be changed for 12^th Jan. 09 beyond the time schedule prescribed by the National Executive. This was unavoidable due to the reason that Com. S.K.Vyas would not be able to reach Mumbai on 8^th Jan. 2009.

The Rally to be organized at Delhi on 2.01.09 must have representative participation from all over the country. The No. of comrades who must be deployed by the concerned COC for the purpose of joining the said rally is indicated hereunder. The COC may kindly ensure that they do deploy the stipulated No. of Comrades i.e. the minimum for participation in the rally.

Dear Comrade,

 

            The National Executive of the Confederation met today as per the notice issued.  The meeting was presided over by Com. S.K.Vyas.  The meeting reviewed the implementation of the decision taken at the meeting held at New Delhi on 26^th August, 2008.  Taking into account that most of the affiliates have endorsed the decision taken to organize an indefinite strike action in pursuance of the 20 point charter of demands.  The meeting took the following decision.

 

a)      To delete point No. 10  (in part I of the charter of demands) i.e. SDA to employees ion NE Region.

b)      To amend point No.4 in part II of the charter of demands as under:

"Replace adhoc bonus with PLB and remove the 60 days ceiling.  Implement the decision of raising the Bonus computation ceiling (Rs 3500) to all persons employed by Govt. of India.

c)      To serve the strike notice on 2.1.2009 by all affiliates and the Confederation    CHQ at Delhi to the respective Heads of Department and Cabinet Secretary respectively.  by holding  a massive demonstration on that day.  Comrades from Delhi, Rajasthan, Punjab, Haryana, UP and selected comrades from all other states will participate in the rally. The number of Comrades each state should deploy to participate will be intimated in our next circular letter. The meeting desired that atleast ten thousand comrades should assemble at Jantar Mantar for the rally in order to manifest our unity and determination in organizing the indefinite strike.  

d)      Such Demonstrations will be held on 6^th Jan. 2009 in all State capitals with massive mobilization of members and will serve the copy of the strike notice on each heads of Offices.

e)      The indefinite strike will commence from 20^th January, 2009.

f)       Besides the 20 point common charter of demands the affiliates may add the sectional demands as is decided upon by the respective organizational fora.

g)      The State COCs will hold state level conventions as part of campaign Programme at the respective State Capitals between 6^th to 9^th January, 2009.  The National leaders of the Confederation and of the affiliates will participate in such conventions.  The meeting decided to have the following dates for the conventions.

25.12.2008-              New Jalpaiguri-West Bengal

03.01.2009-       Delhi.  

06.01 2009        Bhopal, Allahabad, Bhubaneswar, Ranchi,Trivandrum.

h)      Campaign material will be sent in a week's time.  Strike notice proforma alongwith the amended Charter of demands will be circulated alongwith the next circular.  The comrades from the CHQ. who will be attending the state level conventions will be intimated in the next communication.  All affiliates will draw out their campaign Programme separately for the strike action.

 

The meeting appealed all comrades, affiliates and COCs to take every step for the successful conduct of the Strike action, which will commence on 20^th January, 2009.

Dear Comrade,

 

National Convention on Global Financial Crisis

and the need to protect the Banking, Insurance and Pension Sectors –

 

As indicated in our Circular Letter No.D/11/18/2008 dated 21^st November 2008, a National Convention on the above subject will be held at New Delhi on 12^th December  2008. The Venue will be the FICCI Auditorium, near Mandi House, New Delhi. The Convention is slated to be between 11.00 AM to 3.00 PM. It is being co-sponsored by All India State Govt. Employees Federation, Bank Employees Federation of India, All India Insurance Employees Association and the Confederation of Central Govt. Employees and Workers. The Convention is conceived to be of not only educative but also to co-ordinate and canalize all efforts to register an emphatic protest against  the proposed reforms in the Banking, Insurance and Pension Sectors being attempted by the UPA Govt. at the fag end of their tenure.

 

We are entitled to have a minimum hundred participants in the Convention to represent Confederation. Since the National Executive of the Confederation is to meet on 13^th December, our Comrades may avail of this opportunity of reaching Delhi on 12^th itself to participate in the Convention. We shall be grateful if the Comrades will inform us in advance of their willingness to take part in the Convention so that we can make necessary arrangements for collecting Badges etc.. All affiliates and COC may kindly inform us of the number of Comrades, who will participate the Convention by the 8^th December 2008.

 

It has also been decided to organize a mass demonstration in all State Capitals on the same day jointly by the Comrades of the Sponsoring Organisations. The COC Secretary of the State Capitals are requested to get in touch with the leaders of AIIEA, BEFI and AISGEF and finalise the local programme as to the local requirements.

Dear Comrade,

Kindly refer to our letter written to the Hon'ble Prime Minister and the Cabinet Secretary demanding settlement of our 20 point charter of demands placed on the website on 7.10.2008. Before the Prime Minister, we had pleaded for refering the issues to the Group of Ministers already set up for looking into the grievances of the Defence personnel. Our demand before the Cabinet secretary was to settle these issues through a discussion. We have not been favored with a response from either.

It would be therefore appropriate and desirable that we follow it up with a demonstrative Programme of action. The affiliates and C-O-Cs may kindly advise their members to hold a lunch hour demonstration on 8^th December 2008 in front of all offices and send the following telegram to the Prime Minister / Cabinet Secretary.

Solicit kind reference to the Confederation's letter D-16/2008 dated 6.10.2008 and request settlement of demands.

The National Executive had decided upon organizing a Strike Ballot as a method of intensive campaign of the charter of demands amongst the employees and seek their approval for the indefinite strike Programme. Some of the affiliates had asked the confederation of exploring the feasibility of preparing a common format for the same. We suggest the following format for taking the Strike ballot.

"I hereby agree to participate in the indefinite strike action as suggested by the National Executive of the Confederation to pursue the 20 point charter of demands.

Recently the Department of Personnel has issued instruction regulating grant of child Care leave in No 13018/2/2008.ESH(L) dated 18^th Nov.2008. One of the conditions imposed for the grant of Child Care leave is that:

' CCL can be availed only if the employee concerned has no Earned Leave at her credit'

We have demanded for the exclusion of the said condition as it goes to nullify the very purpose of the grant of CCL.

The National Executive of the Confederation will meet at Delhi on 13^th December 2008. Notice for the meeting is enclosed. On 12^th December,2008, a convention will be held at New Delhi (FICCI Auditorium- Mandi House) Co-sponsored by Confederation, AIIEA,BEFI and AISGEF on the subject of Impact of Global financial Crisis on Indian Economy in the light of the further liberalization proposal of the Govt. of India in Banking Insurance and Pension Sectors". The Convention is slated to commence at 11.A.M and will be concluded by 3,00 PM. The National Executive Committee members who are interested to participate may reach Delhi one day in advance.

Notice is hereby given for a meeting of the National Executive of the Confederation on 13.12.2008 at Manishinath Bhawan, A/2/95 Rajouri Garden, New Delhi. 110 027. The meeting will commence at 2.30 PM. The Secretaries of the State COCs as also the Secretaries of the State Capital COCs are requested to kindly attend the meeting.
