MANIFEST SOLIDARITY WITH KERALA AUDIT EMPLOYEES' STRUGGLE AGAINST VICTIMISATION

 

            The audit and accounts employees in Kerala under the banner of Audit & Accounts Association is waging a struggle against the die-hard bureaucracy of Indian Audit & Accounts Department demanding vacation of victimisation of Association activists including women employees. The indefinite fast commenced on 5 th November 2007 is still continuing with the Accountant General administration bent on crushing the employees' movement.

 

            The struggle started in December 2006 against outsourcing of work, the state government entrusted to AG, Kerala. Opposition to the outsourcing led to the suspension of a leading activist of the Association forcing the Association to launch massive dharna to force the AG to withdraw the said punitive action. The suspension was revoked at the intervention of the Chief Minister of Kerala.

 

            The Accountant General started the witch hunting by issuing chargesheets under Rule 14 and Rule 16 to scores of Association leaders and activists, All efforts of the Association leaders to end the spree of victimisations through dialogue was thwarted.

 

            In the month of December 2006, when the Dharna was going on, the Accountant General insisted on entering the office through the gate in front of which the Dharna was being staged, even though clear passage was available to him elsewhere through which he had been entering office earlier.   With wanton disregard to decency and decorum especially to women employees, he is reported to have entered the office, triggering of complaints to the women's Commission by those who were victims of his indecent behaviour.   Angered by this complaint, the AG hardened his vindictiveness against the leaders and activists.  The women complainants have now been proceeded against under various provisions of CCS(CCA) Rules on foisted charges.

 

            As of now reduction to lower stage have been effected in respect of 40 employees, 13 are facing chargesheet under Rule 16, 31are facing chargesheet under Rule 14, 6 are denied of promotion, 6 are given reversion to lower posts and more than 500 have been served with memo with several allegations.

 

            This fight of the Audit and Accounts employees of Kerala for vacation of victimisation deserves whole hearted support by the entirety of Central Government employees. The CAG is a Constitutional Authority. The bureaucracy under him however refuses to imbibe the spirit of the Constitution and denies them the right to function and represent unitedly.

 

            Confederation calls upon every affiliate and CoC to send the following telegram to CAG and Finance Minister, to seek their intervention to vacate the victimization and to demonstrate our support and solidarity with the struggling employees of the Audit and Accounts Offices of Kerala..

As you are aware., the Government took the decision to raise the bonus ceiling for the purpose of computation from Rs 2500 to Rs 3500 after more than a decade.   As per the Press Information Bureau release, this decision of the cabinet is applicable to the bonus payable to the workers for the FY 2006-07 onwards.   The Adhoc and productivity linked bonus in the case of  CG Employees were declared and paid in Sept. Oct. 2007.

 

Confederation has taken up this issue with the Government.  The Secretary of the Staff Side of the JCM National council had also written to the Secretary, Expenditure and  Secretary Personnel, indicating the need for making this applicable to the CGEs. for the year 2006-07 and revise the orders issued in respect of PLB and adhoc bonus.   We have been informed by the Officials in the Finance Ministry that the proposal is awaiting the approval of the Finance Minister.  Perhaps  this may require the sanction from the cabinet too as that has been the procedure adopted in the earlier occasion.  Since the matter is being unduly delayed for no ostensible reason as the Finance Minister was party to the earlier cabinet decision for raising the ceiling limit to Rs 3500,the Confederation desires that Demonstration/Dharna should be organized in front of all Offices and send the following telegram/Saving gram  to Shri P. Chidambaram, Finance Minister, Govt. of India, North Block, New Delhi- 110 001. The  programme of action may be carried out immediately on receipt of this letter by the Units of all affiliates.   The affiliates are requested to kindly convey the decision to their branches and units so that the programme will have wider participation and create sanction to compel the Govt. to take an expeditious and positive decision in this matter.   We are sending this communication through our e-mail and copy of the same has been  placed in our web-site.  Programme may be carried out as and when the message is received by the State/Divisional/Branches.  Confederation has also sent  SMS to all the National Executive Members.

Sub: Raising the ceiling for calculation purpose from the salary of Rs.2500/- P.M. to Rs.3.500/-P.M. for payment of Productivity Linked Bonus for the year 2006-07

 

Sir,

It has been learnt that on 27.10.2007 President has promulgated the payment of Bonus (Amendment) ordinance 2007 according to which section 12 of the payment of Bonus Act 1965 has been amended raising the ceiling for calculation purpose from salary of 2500/- P.M. to Rs.3500/-P.M. w.e.f. 01.04.2006.

 

It is therefore, requested that for the payment of Productivity Linked Bonus/Adhoc Bonus for the year 2006-07 to central Govt. employees the ceiling for calculation purpose from salary also be raised from Rs.2500/-p.m. to 3500/-p.m. and the revised orders issued for payment of Bonus for 2006-07 at the revised ceiling of Rs.3500/-p.m.

 

Incidentally it may also be indicated that when the above ceiling was raised from Rs.1600/-p.m. to Rs.2500/-p.m. by amending Bonus Act in the past, the necessary change was also made in case of Central Govt. employees as well and the difference was paid. It is urged that amendment/ correction may kindly be made without any undue delay so that Central Govt. employees are not unduly exercised

We send herewith a copy of the PIB release indicating that the president has been pleased to promulgate an ordinance on 27 th October, 2007 to amend the Bonus Act . The ordinance has amended section 12 of the Payment of Bonus Act 1965 to raise the Ceiling for calculation Purpose for the salary or wage of Rs. 2500/-p.m. to Rs.3500/- p.m.

 

As you are aware the Ceiling limit of emoluments for the purpose of Calculation of Bonus in the case of Central govt. employees both in respect of PLB and adhoc Bonus is presently Rs 2500/- based upon the    Bonus Act. Since the Bonus Act has now been amended, we request you to kindly take necessary steps to enhance the said Ceiling to Rs 3500/- and issue orders for payment of Bonus at the revised rates for the Central Govt. employees.

 PIB Press Release

On 27th October, 2007 the President has promulgated the Payment of Bonus (Amendment) ordinance, 2007 containing the following amendments:-

i) Amendment to clause (13) of Section 2 of the Payment of Bonus Act, 1965 to raise the eligibility limit for payment of bonus from the salary or wage of Rs. 3500/- per month to Rs. 10000/- per month.

ii) Amendment to section 12 of the Payment of Bonus Act, 1965 to raise the ceiling for calculation purpose from the salary or wage of Rs. 2500/- per month to Rs. 3500/- per month;

iii) Deletion of clause (vi) of section 32 of the Payment of Bonus Act, 1965 so as to cover the employees employed through contractors on building operations.

Thus the employees, including those employed through contractors on building operations will be entitled to receive bonus as per the revised ceilings, for the year 2006-07 and onwards.

The Ordinance shall be deemed to have come into force on
1st April, 2006.
