Dear Comrades,

On the two days General Strike of the working class.

20^th and 21^st February, 2013.

The National Secretariat met on 2.1.2012. The meeting reviewed the extent of participation in the strike action of 12^th December, 201 as also the efforts undertaken by the affiliates/State Committees/National Sectt. Members and others for making it a grand success. The meeting approved the conclusions, contained in and conveyed by our Circular letter No.20/2012 dated 14^th December, 2012 and the Pres Statement issued on the day of strike. It was however, saddening to note that some of the State Committees and affiliates had not sent in the report requisitioned in the format to enable the Sectt. To take concrete steps to remove any deficiency noted during the campaign. The meeting decided to convey our sincere thanks and felicitation to all the leaders, rank and file of the membership in making the strike action the best participated and for the intensive campaign unleashed in the process.

The meeting then discussed at length the steps to be taken to make the two day general strike slated for 20^th and 21^st Feb, 2013 a resounding success amongst the Central Government employees. Many comrades opined that the two day strike being a bold attempt, will face certain difficulties and steps must be taken to overcome those with systematic and sustained campaign programme. Since the AIDEF has decided to join the two days strike action, it must further enthuse our rank and file. The meeting also noted that unlike 12^th December, 2012, there would be general mobilization of the working class throughout the country which must help out immensely in our campaign. The meeting, therefore, decided that the affiliates and Stat e Committees must embark upon an extensive campaign programme reiterating the 15 point charter of demands on which we already had organized a day’s strike along with the national issues, which are being focused by the entire working class in the country. The meeting also noted that since the INTUC and BMS have decided to join the strike action, their affiliates amongst the Central Government employees might participate in the strike giving impetus to the action. The criticism normally erupts whenever we go for industrial action might not be emerging this time. While these are positive factors to make the strike successful, the 48 hour duration of the strike might instill a certain amount of reluctance on the part of our members. This must be taken as a challenge and the campaign must specifically address to erase this reluctance.

As in the past, it has been decided that the National leaders of the Confederation will visit the State Capitals and certain other centres along with the NFPE leaders and organize meetings of activists and members during the months of January and February, 2013. The State Committees are requested to utilize the presence of these leaders and organize atleast (minimum) two meetings to be addressed by them. A chart depicting the names of the leaders and the Stations assigned to them is enclosed. The State committees will decide upon the date/dates of the meeting and will convey the same to the visiting comrades immediately This campaign must be completed by 5^th Feb. 2013 at the latest leaving the rest of the days in the month of Feb. for the State leaders and leaders of the affiliates to concentrate on campaign programmes in the Districts. The State Committees may also get in touch with the other middle class organizations and ensure whether any State/District conventions could be organized jointly. We must ensure that the extent of participation of our comrades in the ensuing general strike on 20rth and 21st Feb. surpasses the number of comrades participated in the one day strike on 12.12.2012

We must convey to our comrades effectively during the campaign that so long as the present economic policies remain the governing principle of governance there may not be any justice imparted to the employees and meaningful negotiation will come about on the basis of strength, unity and struggle only. We must also convey to them that our next step would be to organize an indefinite strike in association with all sections of the Central Government employees. We may in this connection refer to our letter our President has written to Com. Shivgopal Misra, General Secretary, All India Railwaymen Federation (which is already placed on our website). We expect a positive response from the AIRF in the near future. We must articulate our demand for the abolition of the present Pay Band and Grade Pay System and bring back the pay scale structure in the next wage revision. The 7^th CPC must not be allowed to water down the computation of minimum wage. The Commission should also have the requisite authority to go into various anomalies created by the 6^th CPC and address those in consultation with the Staff Side. Above all, this strike is emphatically to bring back the defined benefit pension scheme in replacement of the contributory scheme introduced with effect from 1.1.2004

P.S. The Charter of Demands for the Two Days Strike contains two Parts. The First Part viz., the Part-I contains common issues of Indian Working Class and the Part-II contains the specific issues of Central Government Employees on which we have conducted the recent token strike on 12.12.12. Both Part-I and Part-II are reproduced below:

CHARTER OF DEMANDS FOR TWO DAYS STRIKE

PART – I

Take concrete measures to contain Price rise.
Take concrete measures for linkage of employement protection with the concession / incentive package offered to the entrepreneurs.
Ensure strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.
Universal social security cover for the unorganised sector workers without any restriction and creation of a National Social Security Fund with adequate resources in line with the recommendation of NCEUS and Parliamentary Standing Committee on Labour.
Stoppage of disinvestment in Central and State PSUs.
No Contractorisation of work permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry / establishment.
Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs.10,000/-.
Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.
Assured statutory Pension for all.
Ensure Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions Nos.87 and 98.

PART – II

Revise the wages of the Central Government employees including Gramin Dak Sewaks with effect from 1.1.2011 and every five years thereafter by setting up the 7^th CPC.
Merge DA with Pay for all purposes with effect from 1.1.2011 including for Gramin Dak Sweaks.
Remove restriction imposed on compassionate appointments and the discrimination on such appointments between the Railway workers and other Central Government Employees.
[a] Departmentalise all Gramin Dak Sweaks and grant them all benefits of regular employees; End Bonus discrimination and enhance bonus ceiling to 3500/-; Withdraw open market recruitment in Postman / MTS cadre; Revise cash handling norms; Grant full protection of TRCA; Grant Time Bound Promotion and Medical Reimbursement facility etc.

[b] Regularise the daily rated, contingent, casual workers and introduce a permanent scheme for periodical regularization. Pending regularization, provide them with pro-rata salary at 6th CPC rates.

(a) Revive the functioning of the JCM. Convene the meeting of the Departmental Councils in all Ministries/Departments. Settle the anomalies raised in the National Anomaly Committee as also in the Departmental Anomaly Committees. Hold National Council meetings as specified in the JCM constitution. (b) Remove the anomalies in the MACP Scheme.(c) Grant recognition to all Associations/Federations, which have complied with the formalities and conditions stipulated in the CCS(RSA) Rules.
Fill up all vacant posts and creates posts n functional requirements.
Stop downsizing outsourcing, contractorization, corporatization and privatization of Government functions.
Stop Price rise; Strengthen the PDS.
(a) Stop the proposal to introduce the productivity linked wage system; (b) discard the performance related pay structure; (c) introduce PLB in all Departments; (d) remove the ceiling on emoluments for bonus computation.
Revise the OTA, Night duty allowance and clothing rates.
Implement all arbitration awards.
Make the right to strike a legal and fundamental right of the Government employees on par with the other section of the working class.
Grant Five promotions to all employees as is provided for in the case of Group-A services.
(a) Withdraw the PFRDA Bill. (b) Rescind the decision to allow FDI in pension sector;(c) Scrap the new contributory pension scheme (d) Extend the existing statutory defined pension scheme to all Central Govt. employees irrespective of their date of entry in Government service.
Vacate all Trade Union victimisation, and more specifically in the Indian Audit and Accounts Department.

GOVERNMENT ORDERS ON GRANT OF INCREMENT ON PROMOTION TO THE SAME GRADE PAY POSTS IN THE SAME PB

GOVERNMENT ISSUES ORDERS GRANTING ONE INCREMENT TO OFFICIALS PROMOTED FROM FEEDER CADRE OF THE SAME PB WITH SAME GRADE PAY.

The Government has issued orders granting one increment for those who are promoted from a feeder cadre which has the same PB and Grade Pay as that of the promoted cadre. Copy of the order is placed on the website for your ready reference. The order to give effect to the agreement reached in the National Anomaly Committee to remove the anomaly in the case of promotes and direct recruits in fixation of pay is yet to be issued. There had been some queries raised by the Finance Minister in the matter. It is learnt that the same is being referred to the Department of Personeel for their comments and necessary action.

OFFICE MEMORANDUM

Subject:- Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.

The undersigned is directed to invite an attention to the provisions contained in Rule 13 of the CCS(RP) Rules, 2008, which provides for the method of fixation of pay on promotion on or before 1.1.2006 in case, inter-alia, of promotion from one grade pay to another. The Rule provides for fixation of pay by way of addition of one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay (rounded off to the next multiple of 10) to the existing pay in the pay band and then fixing the pay if the promotional post as per the procedure prescribed therein.

2. In terms of this Ministry’s OM No.109/2/2000-IC dated 24.11.2000, dealing with the situation whereby both the feeder and the promotional grades were placed in the identical revised pay scales based on the recommendations of the 5^th Central Pay Commission, it was provided, inter-alia, that only in cases where it was not found feasible to appropriately restructure cadres in question on functional, operational and administrative considerations, extension of the benefit of fixation of pay under FR 22(1)(a)(1) could be considered on the merits of each case, provided all the conditions precedent for the grant of this benefit were fully satisfied and promotion to the post in question actually involved assumption of higher responsibilities.

3. In view of the provisions which existed prior to 1.1.2006, the matter has been considered and the President is pleased to decide that in cases of promotion from one post to another where the promotional post carries the same Grade Pay as the feeder post, the fixation of pay in such cases will be done in the manner prescribed in Rule 13(i) of CCS(RP) Rules, 2008, provided fixation of pay in such cases was done prior to 1.1.2006 in terms of this Ministry’s aforesaid OM No.169/2/2000-IC dated 24.11.2000.

4. In so far as the persons serving the Indian Audit and Account Department are concerned, these orders are issued in consultation with the Comptroller & Auditor General of India.

Dear Comrade,

I may invite your kind reference to the letter on the subject I had sent you earlier, wherein I had requested you to take initiative in convening a meeting of the leaders of all organisations participating in the JCM. JCM as a negotiating forum, as you are aware, has virtually come to a halt. It was in May, 2010 that the National Council met on the last occasion. Barring Railways, Defence and to some extent the Postal, the Departmental Councils of other Ministries/Departments have not been meeting since 1995. In some departments, these councils have ceased to exist as the Government on one pretext or the other has not been granting recognition to the Service Associations, even though they had complied with all the conditions stipulated in the CCS(RSA) Rules, 1993. Most of these organisations having only a few thousand members are incapable of forcing upon a decision in the matter through agitation.

Though we had been raising this issue on a number of occasions and despite solemn assurances held out by the official side, nothing tangible has come about. It is unlikely that the Government will consider revival of the negotiating forum unless we jointly demand effective functioning of the JCM at all levels and follow it up with joint agitational actions.

As you are aware, the 6^th CPC made very retrograde recommendations in respect of Group B,C and D employees. The Pay band prescribed for the above category of employees was equal to the pay+DPA +DA i.e. 1.86 times of the minimum of the basic pay of the lowest in the group, whereas the pay band for Group A posts was fixed by multiplying their prescribed basic pay by a factor ranging from. 2.2 to 2.63 (S.30, S.25). Similarly grade pay was to be 40% of maximum of pre-revised pay scales whereas in the case of Group A officers it was later revised to 44 to 49%.

Several anomalies were raised by us in the National Anomaly Committee. After procrastinated discussions, except cosmetic changes, none was settled. I have now been informed that even what was agreed to in the last meeting of the National Anomaly Committee, has been turned down by the Finance Ministry. In all through the discussions at the Anomaly committee meetings, you must have noticed that reasoning has been the casualty.

The high ranging inflation in the economy especially in the last 3 years has caused soaring rise in the prices of all essential commodities especially food items. Major portion of the salary of the low paid workers is consumed for accessing the food items. The prices adopted by the 6^th CPC in determination of the minimum wage have now registered an increase of more than 162% and the DA compensation is just 72%. This apart, the recommendation of the 6^th CPC being effective from 1.1.2006 has been in vogue for 5 years as on 1.1.2011. In the case of all Public Sector undertakings, the Govt. has now agreed to effect wage revision after every five years. We have, therefore, to demand the setting up the 7^th CPC without any further delay It has been our experience, as you will agree with me, that the Government had agreed for setting up pay commission for wage revision only when we unitedly placed the demand and backed up the same with recourse to strike action.

There are other issues too which brooks no delay in bringing about settlement viz. the implementation of arbitration awards, merger of DA with pay, withdrawal of the PFRDA Bill, compassionate appointmentsetc.etc.

The AIRF is the biggest Federation representing the largest number of Railway workers amongst the Central Government employees and naturally we expect you to kindly take initiative in convening a meeting of the leaders of all organisations participating in the JCM to form a JCA to pursue the long pending issues demands of Central Government employees. I shall also be grateful for favour of your considered view in the matter.

Sub:"incentive increments to sports persons for outstanding sports achievements, National and International levels.

Ref: Your letter MNo. 6/2/2008 Pay I dated August, 2008.

Kindly refer to the above cited letter.

The practice of giving incentive increments to the sportsperson who excel was to be replaced with lump sum grant. Views were called for by the Department of Personnel from all Ministries/Departments as also individuals. We have felt that there was no need to change the existing system as we found to be a better financial benefit in the longer run. Lumpsum grant however, large it may be will not help the persons who have worked hard in their youthful days. However, we felt that the sportsperson must have a say in the matter.

More than 4 years have passed now. No views from the Ministries or individuals seem to have been received by the Department of Personnel. Or if received it has not been made known.

It has been represented to us that in the name of changing the entire scheme itself, the incentive increment system was in vogue was discontinued with effect from 1.1.2006. As you are aware, the scheme was introduced in Government service with effect from 1985 with a view to attract the sports personnel to choose the Government service and more so to encourage them so that they can acquit themselves creditably.

We, in the circumstances, request that the incentive scheme may be revived and made effective from 1.1.2006. In the case of all allowances which are incentive in character, the Government had doubled the amount after the 6^th CPC.

The action taken in this regard may please be intimated to us.
