Dear Comrade,

 

            We append hereunder a copy of the letter we had addressed to the Secretary Expenditure, Government of India, demanding that the calculation ceiling be raised to Rs. 3500 in the case of grant of adhoc bonus.  The letter pertains only to adhoc bonus as the orders relating to PLB are yet to be issued.

            We request all affiliates and COCs to send similar letters (with necessary modification for those covered by PLB Scheme) to the Secretary Expenditure immediately on  receipt of this communication with copy endorsed to the CHQ.

            It has come to our knowledge that the Govt. might raise the calculation ceiling to Rs. 3500 either to the Railway workers alone as was done in 1996 or for all those covered by the PLB Scheme.  This, if done will be a gross discrimination in respect of employees covered by the Adhoc bonus and must warrant immediate action programme including strike as was carried out in 1996.  We request our affiliates and COCs to prepare the rank and file of the workers for such an eventuality.

            As per the decision of the National Executive Committee meeting, we have addressed the Secretary General, All India Defence Employees Federation to explore the possibilities of organizing a united action in pursuance of the unsettled demands of the Charter pertaining to the 6th CPC issues.

            We hope you must have gone through by now the various instructions, rules, and orders issued by the Government in implementation of the 6th CPC recommendations and must have noticed certain incongruities, anomalies and other difficulties. We have been receiving such complaints from the members of different organizations.  We, therefore, request you to kindly go into this matter and send us in writing such anomalies and incongruities noticed by you or brought to your notice by the members to enable us to make representation before the Government.

Madam,

 

            We solicit you kind reference to the O.M. No. 7/22/2008.E-IIIA dated 5th September, 2008 granting adhoc bonus to employees who are not covered by the PLB Scheme for the accounting year 2007-08.  It has been mentioned therein that the calculation ceiling of Rs. 2500 would remain unchanged.

 

            As you are aware, the calculation ceiling of Rs. 2500 was imposed in consonance with similar provision in the Bonus Act as is applicable to industrial workers. The said ceiling of Rs. 2500 was raised to Rs. 3500 by the Government and made applicable to the workers covered by the Bonus Act for the accounting year 2006-07 itself.  We had taken up the issue both through correspondence and in the JCM Standing Committee immediately on promulgation of the ordinance raising the ceiling limit to make it applicable to Government employees.

 

            We expected the Government to raise the ceiling limit to Rs. 3500 before orders are issued for the grant of adhoc bonus pertaining to 2007-08.  We request you to kindly issue necessary orders to raise the calculation ceiling limit to Rs. 3500 applicable for the grant of adhoc bonus for the accounting year 2006-07 onwards.

Please refer to the Confederation Circular letter No.D/11/13/08 dated 27th August, 2008. As per the decision taken at the NE meeting held on26.08.08 we were to elicit suggestions from all concerned while formulating and finalizing the Charter of Demand. The last date for receipt of the suggestions was on 10th Sept. 2008.

 

On the basis of the suggestions so received we have now finalized the Charter of Demands.  The same is enclosed.

 

You may kindly ensure that the Charter of Demands is popularized amongst the mass of the employees and the same is presented to the Govt. through the concerned Heads of Department on 19th Sept. 2008.

Charter of demand

 

  1. Grant Rs 10000 as minimum wage as per 15 ILC Norms.
  2. Grant minimum fitment benefit of 2.625 times of pre-revised basic pay to bring about uniform rise in emoluments and raise grade pay to 50% of the maximum of the  pre-revised scales in respect of PB 1,2 & 3 as has been done in the case of PB 4.
  3. No abolition of Gr.D. Posts and functions.  Lift ban on recruitment, fill up all vacant posts and scrap screening Committee.
  4. Grant 10% of pay+ Grade pay as minimum benefit on promotion or financial up gradation.
  5. No outsourcing or contractorising of Govt. functions.
  6. Fix the date of effect of all allowances as 1.1.2006.
  7. No reduction  in the commutation value and restoration of full pension after 12 years.
  8. Grant statutory defined pension scheme to the employees recruited after 1.1.2004 and withdraw the PFRDA Bill from Parliament.
  9. Compute the pension entitlement on the basis of notional pay as on 1.1.1996.

10. No performance related pay or bonus scheme.

11   Implement the Board of Arbitration Awards.

12. Remove the arbitrary 5% ceiling and 3 years condition on compassionate       appointment and withdraw court  cases and absorb all waitlisted RRR candidates.

13.Implement the revision of bonus ceiling @ 3500/- in the case of Govt.  Employees: Remove adhoc bonus and replace it with the PLB and remove the 60 days ceiling.

14.Grant SDA to all employees in NE Region.

15.Revise the Transport and daily allowances as demanded by the staff side JCM National Council.

16.Remove the condition of 6 months for applying the uniform date of Ist July as increment dates.

17. ACP to be on hierarchical system obtaining in each department.

18. Retain and improve CGHS and make insurance scheme optional.

19.Implement flexitime working hours for women/disabled employees as recommended by the 6 CPC.

20.Direct all the Departmental Heads to settle 6th CPC related department specific demands/problems within a stipulated time.

21. Grant civil servant status and  Pension to 'Gramin Dak-Sevaks.'

POST 2006 PENSIONERS - ORDERS RELEASED

This Order is for those who retired and retire on or after 1.1.2006.

 

For those already Pension etc are fixed, those will be revised on the basis of this order. However if old pension is found to be more advantageous then under the present orders then it would not be revised in a disadvantageous manner.

Finance Ministry Orders on Children Education Allowance / Tuition Fee is released on acceptance of the recommendation of the 6th Pay Commission in this matter.

 

As per the recommendation of the Pay Commission, the Government has merged both the Children Education Allowance and Tuition Fees and fixed the quantum payable as Rs.1000/= per child restricted to a maximum of two children. Accordingly Rs.2000/= per month would be the permissible quantum for the CG Employees, who have at least two school going children.

 

This order is applicable for children who study from Nursery to Twelfth including classes 11th and 12th held by junior colleges or schools affiliated to Universities or Boards Education.

 

The most important aspect of the Government order is that henceforth even if the children fail in a class, the reimbursement of Children Education will not be stopped but continue to be paid.

 

The maximum quantum that can be claimed in a year per child by quarterly claims cannot exceed Rs.12,000/=.

 

However as in the case of LTC, only one person can claim this if both the spouses are Government Employees.

 

To benefit an easier claim the certification for the claim is enough to be self certified by the claiming Government Employee with original Receipts for payment of fees in the schools. No certification is necessary from the Scholl Principal or Headmasters.
